New Public-Private Partnerships law

The National Assembly adopted a new law on Public-Private Partnerships (PPPs). The law was proposed by the Senegalese Government to “ensure that PPP projects are competitive and meet the specific needs of the population” by adopting “a flexible legal framework that provides security for investors and promotes the rapid implementation of high-quality, job-creating PPP projects”.

Besides setting forth a unified legal framework for all PPP projects, the new law also establishes a regime for unsolicited bids and introduces specific provisions relating to local content requirements.

In addition, the PPP law provides for the creation of a PPP Unit composed of financial and legal experts who will support the contracting authorities in the identification, development and implementation of PPP projects.

Implementing regulations are expected soon, upon the enactment of which all the principles, rules and requirements set out in the PPP law will become fully applicable.
