The CMC approved Regulation No. 2/21, of 4 June 2021, which entered into force on the same date. The Regulation developed the regime provided for in the legal regime covering guarantee funds of management companies of regulated markets, clearing houses, central counterparty and centralized securities systems, especially with regard to the following: rules on the incorporation, organization and functioning of guarantee fund management companies; the nature of damage to be compensated for; and the criteria for compensation for damage.
Guarantee fund management companies must have a minimum share capital of Kz 30,000,000.
The management companies of regulated markets, the clearing house, the central counterparty, and the central securities depository, must set up mandatory accession funds within a period of one year, as from the date of entry into force of the Regulation.
