BNA Order No. 23/20, of 29 December 2020, established the rules and procedures for handling receipts and transfers abroad, of any nature, ordered by State Bodies, including: payments to international organizations; payments for the acquisition of goods or contracting of services; and capital operations, namely loans from abroad and the respective repayments, and the receipt of donations from abroad.
This Order applies to the Bodies of the State's Direct Administration, especially: the Presidency of the Republic, Vice-Presidency of the Republic and Ministerial Departments; the Bodies of the Indirect State Administration, particularly the Autonomous Administrations and Public Institutes; the National Assembly and the Superior Bodies of the Justice Administration, especially Superior Courts and the Attorney General's Office. The Order does not apply to public and mixed companies, endowed with legal personality under private law, with own assets and exclusive capital, with incorporation authorized by specific law for engagement in an economic activity.
The foreign exchange operations covered by this Order are exempt from licensing by the BNA. However, their execution is subject to validation and SINOC registration by banking financial institutions, following the procedures identified in the Order, and the relevant settlement may only be carried out by bank transfer.
The Order also identifies the documents that must be presented to banking financial institutions to validate transactions related to payments for the importations of goods and payments for current invisibles, determining the requirements that such documents must fulfill.
