Presidential Decree No. 154/16, of 5 August 2016, on the legal framework of fines for breach of Law No. 7/15, of 15 June 2015 (General Labor Law) and other ancillary statutes has just been published. The statute repealed Decree No. 11/03, of 11 March 2003, which regulated the same subject regarding breach of the former General Labor Law (Law No. 2/00, of 11 February 2000). The Presidential Decree came into force on 5 August 2016.
This new legal framework updates the penalties applicable to companies for breaches of labor provisions in force. Briefly, the new statute entails a significant increase in fines applicable to non-complying companies. Also, the statute of limitations period which used to be 2 years is now 5 years.
