New Legal Framework for Disability Protection

On January 29, 2025, it was enacted in Angola Presidential Decree No. 15/25, establishing a comprehensive Legal Framework for the Protection of Employees with Absolute Disabilities Resulting from Non-Occupational Causes under Mandatory Social Protection.

This new framework seeks to update and clarify the rules governing compensation for the total loss of work-related earnings caused by absolute disability. It defines key terms, eligibility criteria, exclusions, and guarantee periods, ensuring a more structured approach to disability benefits.

Additionally, the decree outlines procedures for assessing, certifying, and reviewing disabilities, enhancing the regulation of evaluations and disability pension payments.

Thus, by streamlining benefit application processes and improving accessibility, the decree strengthens Angola’s social protection system, making it more efficient and supportive for employees in need.

Alongside with the abovementioned statute, Presidential Decree No. 16/25 was also enacted on the same day setting the operational framework for the Disability Assessment and Verification Service (SAVI).

This decree outlines the procedures for assessing and verifying disability conditions and their continuity. It also establishes guidelines for appointing medical experts, emphasizing their independence and addressing potential conflicts of interest.

Furthermore, it defines the structure and responsibilities of the Evaluation, Verification, and Reassessment Committees, as well as the entire procedural framework, including the possibility of appealing the Committee's decisions, which will be reviewed and assessed by an autonomous Appeals Committee.

Thus, by strengthening procedural rules for disability assessment and verification, this decree enhances transparency, clarifies key procedural steps, and ensures a more structured and reliable evaluation process.
