A New Labor Code has just been approved by Law No. 6/2019, of 11 April 2019, which was been recently published in the Official Gazette. This law will come into force on 10 July 2019 and will repeal several statutes, including the Legal Framework on Employment Conditions approved by Law No. 6/92, of 11 June 1992, that had been in force for more than twenty-six years.
Amongst the most significant changes introduced by the New Labor Code, the following are highlighted:
• Introduction of rules on employees’ right to privacy and on equality and non-discrimination;
• New rules on fixed term hiring;
• Introduction of new rules regulating restrictive covenants;
• Substantial change of rules on disciplinary proceedings;
• New regime on transfer of undertakings;
• Introduction of a new regime for the occasional intra-company assignment of employees;
• Substantial change to various rules on working time requirements;
• New rules on termination of employment contracts, procedures and compensation.
