New General Labor Law Rectification
Rectification no. 2/24, of 1 March 2024, has just been approved amending some typos of the General Labor Law version that had been gazetted last 27 December 2023.
Amongst the points subject to rectification the following are the most relevant:
- Fixed term employment contracts – The maximum duration of 36 months applies to employment contracts whose underlying reason is the (i) replacement of absent employees, (ii) hiring of long-term unemployed individuals or persons subject to social insertion or reinsertion, (iii) execution, management and supervision of civil construction and public works, industrial assembling or repairs and other tasks of similar nature, and (iv) practical apprenticeship and training.
- Constructive dismissals and resignations with just cause by the employee for reasons deemed to be false entail the payment by the employee of the salary of 30-day notice period not given to the employer.
The Rectification is effective as of 1 March 2024.
