BNA Order No. 14/22, of 5 July 2022, was recently enacted, with the aim of simplifying the rules applicable to foreign exchange capital operations. This statute establishes new rules for foreign exchange capital operations by legal persons, notably financing agreements and other legal acts by which rights or obligations are created or transferred between residents and non-residents. These operations are no longer subject to licensing by BNA but may only be carried out provided certain requirements are met, to be verified by commercial banks. This Order entered into force on 6 July 2022 and repealed BNA Instruction No. 1/03, of 7 February 2003.
