Amendments to the Golden Visa Regime

Decree-Law no 14/2021, of 12 February was published, amending the legal regime of entry, stay, departure and removal of foreigners from national territory.
 
Pursuant to Law no. 2/2020, of 31 March, which approved the State Budget for 2020, the Portuguese Government was authorized to review of the legal regime of residence permits for investment purposes – in Portuguese, “ARI” – or commonly referred to as Golden Visa.

Following the aforesaid authorization, the Government has now approved the following changes:

a. The investment consisting of transfer of funds is increased from 1 million euros to 1.5 million euros;

b. The investment consisting of transfer of funds applied to research activities carried out by public or private scientific research institutions, included in the national scientific and technological system, is increased from € 350,000 to € 500,000;

c. The investment consisting of transfer of funds intended to the acquisition of participation units in investment funds or venture capital funds aiming to the capitalization of companies, incorporated according to Portuguese law, whose maturity, at the time of the investment, is of, at least, five years and, at least, 60% of the value of the investments is carried out in commercial companies based Portugal, is increased from € 350.000 to € 500.000;

d. The investment consisting of transfer of funds intended to the incorporation of a commercial company with registered address in Portugal, together with the creation of five permanent jobs, or to reinforce the share capital of an existing commercial company with registered address in Portugal, with the creation or maintenance of a minimum of five permanent jobs and for a minimum period of three years, is increase from € 350.000 to € 500.000.

The amounts pertaining to investment consisting of purchase of real estate remain unchanged at: i) an amount of at least € 500.000 and ii) an amount of at least € 350.000 if the construction was completed at least 30 years ago or is located within an urban rehabilitation area and rehabilitation works will be performed. However, pursuant to the new statute, the Golden Visa will only be granted if the real estate asset is located in the Autonomous Regions of Azores and Madeira or in countryside territories, identified in the Annex to Ordinance no. 208/2017, 13th July
 
The new statute comes into force on 1 January 2022.
